DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

1.2 BUYER
The person whose name, delivery and billing address, phone number and email address are provided at the time of the order.

ARTICLE 2 – SUBJECT

The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product(s) ordered electronically by the BUYER on boudoir.ist.

ARTICLE 3 – PRODUCT, PAYMENT AND DELIVERY

3.1 The basic characteristics, quantity and sales price including all taxes of the product are stated on the product page, in the order summary and on the invoice. Advertised prices and promotions remain valid until updated.

3.2 Payment is made in full or by credit card using the methods offered at checkout. The SELLER does not charge late payment interest.

3.3 Shipping is free for all orders within Turkey. For international orders, the shipping fee is shown at checkout and added to the order total.

3.4 Orders within Turkey are delivered to the BUYER within 2–4 business days in Istanbul and 2–7 business days in other cities following confirmation. Delivery will in any case not exceed the statutory 30-day period.

ARTICLE 4 – GENERAL PROVISIONS

4.1 The BUYER declares that they have read the Preliminary Information Form regarding the basic characteristics of the product, the sales price including taxes, payment method, delivery terms and the SELLER’s contact details, and has given the necessary confirmation electronically.

4.2 The product is delivered to the BUYER or to the person at the address indicated by the BUYER. The SELLER cannot be held responsible if a person other than the BUYER refuses the delivery.

4.3 Parcels found to be damaged at the time of delivery should not be accepted, and a report should be drawn up by the carrier.

4.4 For a justified reason, and after informing the BUYER and obtaining their consent, the SELLER may supply a different product of equal quality and price before the performance period expires.

4.5 If the supply of the ordered product becomes impossible, the SELLER will notify the BUYER within 3 days of becoming aware of it and refund the amount collected within 14 days.

4.6 If, after delivery, the relevant bank or financial institution does not pay the product price to the SELLER due to unauthorized use of the BUYER’s payment instrument not caused by the BUYER’s fault, the BUYER must return the product to the SELLER within 3 days.

ARTICLE 5 – RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES

5.1 Except for the products listed in Article 6, the BUYER may exercise the right of withdrawal within 14 days of the order date without giving any reason.

5.2 The right of withdrawal is exercised by notification via the Return & Exchange Form on boudoir.ist or by email to hello@boudoir.ist. The BUYER must send the product back to the SELLER within 10 days of the notification.

5.3 Returns are shipped with Aras Kargo or Sürat Kargo. Return shipping is paid by the BUYER. The BUYER may choose to pay the fee when shipping or to have it deducted from the refund, and states this preference in the return form.

5.4 The SELLER refunds the product price (less the return shipping fee, if the BUYER chose this option) in a single payment in accordance with the BUYER’s payment method, no later than 14 days after the returned product reaches the SELLER. For instalment purchases, the bank refunds with the same number of instalments; the time for the amount to appear in the account depends on the bank.

5.5 The product to be returned must be unworn, unwashed, not altered by a tailor, and sent complete and undamaged with its tags and original packaging. The original invoice does not need to be sent.

5.6 Except for the products listed in Article 6, the BUYER may request one free size or style exchange within 14 days of the order date. No shipping fee is charged for exchanges.

ARTICLE 6 – PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

In accordance with the Distance Contracts Regulation, the right of withdrawal cannot be exercised and no exchange is made for the following products:

• All lingerie (bras, briefs, thongs, garter belts and lingerie sets), bodysuits and accessories, whose return is not suitable for health and hygiene reasons
• Products that have been worn, washed or altered by a tailor at the BUYER’s request
• Digital gift cards delivered instantly in electronic form

ARTICLE 7 – DEFECTIVE PRODUCTS

For defective or incorrectly shipped products, the BUYER may exercise the optional rights set out in Article 11 of Law No. 6502. In this case, shipping costs are borne by the SELLER and the exclusions in Article 6 do not apply.

ARTICLE 8 – DISPUTE RESOLUTION

Turkish Law applies to disputes arising from this Agreement. Within the monetary limits announced annually by the Ministry of Trade, the Consumer Arbitration Committee or Consumer Court at the BUYER’s place of residence or where the consumer transaction took place has jurisdiction.

ARTICLE 9 – ENTRY INTO FORCE

By confirming the order, the BUYER declares that they have read and accepted all terms of this Agreement. The Agreement enters into force upon confirmation of the order and a copy is sent to the BUYER with the order confirmation email. For matters not covered herein, Law No. 6502 and related legislation apply.
